Good morning forum members. I am posting this here today on behalf of my younger brother because our family is currently dealing with an absolute nightmare situation and we are completely losing sleep over it. He is a 19-year-old G2 novice driver here in Ontario, and he relies on his car every single day to commute from Mississauga to his morning classes at York University, and then straight to his evening part-time shift at a local grocery store. Losing his ability to drive will basically derail his entire semester and cause him to lose his job, which he uses to pay for his tuition.

Last night, he was trying to merge onto the QEW near Hurontario Street during heavy rain and terrible visibility. The highway traffic was moving incredibly fast, and according to his account of the event, a massive commercial transport truck suddenly cut into his lane without signaling. In a moment of panic, he had to accelerate hard and swerve slightly onto the ramp to avoid getting crushed by the truck's trailer. Because the asphalt was completely soaked, his rear tires lost traction and spun out for just a brief second before he regained full control of the vehicle. Unfortunately, an unmarked OPP police cruiser was sitting right there on the shoulder. The officer pulled him over immediately, refused to listen to any explanations about the truck, didn't want to look at his dashcam footage on the spot, and charged him with stunt driving under the Ontario Highway Traffic Act for "intentionally causing tires to lose traction."

We are completely devastated by how fast things escalated. Right there on the side of the highway, the officer called a tow truck, impounded our family car for 14 days, and suspended my brother's driver’s license for 30 days. We haven't even received an official court date yet, and we are already facing thousands of dollars in immediate towing, storage, and administrative fees that we simply cannot afford right now. To make matters worse, for a novice G2 driver in Ontario, an actual conviction for stunt driving is a complete financial death sentence. Plus, a conviction carries a mandatory minimum license suspension of one to three years and heavy court fines that can go up to $10,000.

Pleading guilty or letting him walk into a provincial offences court alone to try and explain the emergency situation to a judge is simply out of the question. He has absolutely no idea how the legal system works, and the Crown prosecutors are notoriously brutal on young drivers facing these types of severe infractions. We absolutely need to hire a highly experienced, aggressive legal professional who knows exactly how to request full disclosure, analyze the officer's notes, cross-examine the police in court, and find technical or procedural errors in the prosecution's evidence.
